Welcome to Subtly You. By accessing our website, booking an appointment, purchasing a product, treatment, package, gift card, or promotional offer, you agree to the following Terms of Service. Please read them carefully.

1. General Information

Subtly You provides cosmetic, aesthetic, skincare, and wellness-related services and products. All services, treatments, promotions, and offers are subject to availability and may be modified, suspended, or discontinued at any time without notice.

Use of our website, purchase of products or services, and booking of appointments indicates your acceptance of these Terms of Service.

2. Medical Disclaimer

Our services may include medical aesthetic consultations and treatments. Information provided on our website, social media, marketing materials, or in-clinic is for general informational purposes only and does not replace a medical assessment, diagnosis, or advice from a qualified healthcare professional.

Not all treatments are suitable for every individual. Eligibility for treatment is determined during consultation and, where applicable, by the appropriate licensed medical provider. Individual results vary and are not guaranteed.

3. Appointments and Consultations

Appointments may be booked online, by phone, or in person. We reserve the right to reschedule, decline, or cancel appointments where necessary.

Some services may require a consultation before treatment. Booking a consultation or appointment does not guarantee treatment will be performed. Treatment suitability is determined at the time of consultation and may depend on medical history, contraindications, provider assessment, and clinical judgment.

4. Pricing and Payment

All prices are listed in CAD unless otherwise stated. Prices are subject to change at any time without notice.

Payment is due at the time of purchase or service unless otherwise specified. We reserve the right to refuse or cancel any order, booking, or promotion where pricing, availability, or offer details were displayed incorrectly due to error.

5. Promotions, Offers, Vouchers, and Gift Cards

From time to time, Subtly You may offer promotions, discounted pricing, vouchers, bonus gift cards, promotional gift cards, and special offers. Unless explicitly stated otherwise in writing, the following terms apply:

  • Promotions may not be combined.
  • Bonus and promotional gift cards may not be used toward discounted services.
  • Botox offers or special pricing may not be used toward lip flips unless otherwise stated explicitly in the offer.
  • Vouchers, promotions, offers, and promotional gift cards — defined as any gift card or certificate issued without proof of purchase for a dollar amount — are limited to one use per customer.

Additional promotional terms:

  • Promotions have no cash value and may not be redeemed for cash.
  • Promotions are non-transferable unless explicitly stated otherwise.
  • Promotions cannot be applied to previous purchases or previously booked services unless stated otherwise.
  • Expiry dates apply where listed.
  • We reserve the right to verify eligibility for any offer and to refuse redemption where misuse, duplication, or violation of promotional terms is suspected.
  • Promotional pricing applies only within the stated promotional period and under the stated conditions.

6. Gift Cards

Purchased gift cards with proof of payment for a dollar amount may be used toward eligible services or products, subject to any applicable restrictions. Promotional, bonus, complimentary, or donated gift cards may be subject to separate conditions and exclusions.

Gift cards:

  • are non-refundable,
  • are not redeemable for cash,
  • must be presented at time of redemption if required,
  • may not be replaced if lost or stolen unless required by law.

7. Packages, Prepaid Services, and Payment Plans

Packages, series, prepaid services, and payment plans are subject to the specific terms provided at the time of purchase. Unless otherwise stated, all prepaid services and packages are valid for one (1) year from the original purchase date or initial package sign-up date, including where payment is made through an installment or payment plan arrangement.

The validity period is based on the initial date the package or prepaid service is entered into, not the date of any individual installment payment, renewal payment, or later use, unless otherwise stated in writing.

Unless otherwise required by law or expressly stated by Subtly You:

  • packages and prepaid services are non-refundable,
  • unused services are non-transferable,
  • services included in a package may not be exchanged for cash or substituted outside the package terms.

8. Cancellations, No-Shows, and Late Arrivals

We ask that clients provide 48 hours notice for cancellations or rescheduling. Failure to provide the required notice, repeated no-shows, or arriving too late for an appointment may result in a cancellation fee, forfeited appointment privileges, shortened appointment, or loss of promotional pricing, package use, or booking privileges.

Specific cancellation policies may be communicated at the time of booking and form part of these Terms.

9. Refund Policy

Due to the nature of medical aesthetic, cosmetic, and personal care services:

  • completed services are generally non-refundable,
  • injectable treatments, treatment packages, and prepaid services are generally non-refundable,
  • skincare and retail product returns may only be accepted in accordance with our product return policy, if applicable.

If you have concerns about your treatment or purchase, please contact us directly so we can review the matter.

10. Treatment Results

Aesthetic and medical aesthetic outcomes vary from person to person. Subtly You does not guarantee specific results, duration of results, or satisfaction with any service or product. Treatment recommendations are based on professional assessment, but individual response can differ.

11. Client Responsibility

By booking or receiving services, you agree to provide accurate, complete, and current information about your health history, medications, allergies, contraindications, and prior treatments. Failure to provide accurate information may affect treatment eligibility, safety, and outcome.

You are responsible for following all pre-care and post-care instructions provided by our team.

12. Website Use

You agree to use our website only for lawful purposes. You may not:

  • misuse the website,
  • attempt unauthorized access to the website or its systems,
  • copy, reproduce, or exploit website content without permission,
  • use the website in any way that may damage, disable, or impair its functionality.

13. Intellectual Property

All content on this website, including text, branding, logos, graphics, images, videos, service names, and design elements, is the property of Subtly You unless otherwise stated and may not be copied, reproduced, distributed, or used without prior written consent.

14. Privacy

Your use of our website and services is also governed by our Privacy Policy. By using our website or submitting your information, you consent to the collection and use of information in accordance with that policy.

15. Limitation of Liability

To the fullest extent permitted by law, Subtly You, its owners, employees, contractors, providers, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from:

  • use of our website,
  • booking or receiving services,
  • inability to receive treatment,
  • dissatisfaction with results,
  • errors, interruptions, or website unavailability,
  • misuse of promotions, gift cards, or vouchers.

Nothing in these Terms limits rights that cannot be excluded under applicable law.

16. Right to Refuse Service

We reserve the right to refuse service, cancel appointments, limit purchases, or deny redemption of any offer, voucher, promotion, or gift card where permitted by law, including in cases involving safety concerns, inappropriate conduct, suspected fraud, policy abuse, or treatment unsuitability.

17. Changes to These Terms

We may update these Terms of Service from time to time without prior notice. The updated version will be posted on this page with a revised effective date. Continued use of our website, booking system, or services after changes are posted constitutes acceptance of those changes.

18. Governing Law

These Terms of Service are governed by the laws of the Province of Ontario and the laws of Canada applicable therein, unless otherwise required by applicable consumer protection legislation.
